Cadwalader partners Brian Foster, Samantha Hutchinson and Nathan Parker are contributing authors of the recently released Global Legal Insights – Fund Finance 2022, the sixth edition of this comprehensive guide to the fund finance market published by Global Legal Group.
Michael Mascia, who co-chairs Cadwalader's Finance Group and is a leader of the firm's Fund Finance practice, has been the publication’s contributing editor since its launch.
The “Pink Book,” as it’s called, features 24 product- and market-oriented chapters and 18 jurisdictional updates.
Mascia authored the Introductory chapter, in which he provides a high-level overview of key fund finance industry themes in 2021, within the context of the broader private capital markets, and shares his thoughts on potential developments in 2022. It can be read here.
Foster and Hutchinson co-authored “Navigating Alternative Liquidity Solutions,” which highlights various financing trends since March 2020 – including “PRAV” facilities, preferred equity solutions and continuation financings – and how they work for particular liquidity needs. Read the chapter here.
Hutchinson, Cadwalader’s Head of Fund Finance, UK, and Parker again co-authored the jurisdictional chapter covering England and Wales, which considers the role of English law in fund financings across Europe, as well as the varied subscription finance structures that have developed in the English fund finance market.
