Cadwalader is representing Mod Champagne in trademark infringement and false advertising actions against national retailer Total Wine. The suit also named Blicker Pierce Wagner Wine Merchants LLC.
The lawsuit filed in California federal court alleges that Total Wine conspired with distributor Southern Glazer's Wine & Spirits to destroy the Mod Champagne brand, which has been actively promoted by singer and influencer Drake. Central to the suit are alleged violations of the Lanham Act’s bans on false advertising, unfair competition and trademark infringement.
Cadwalader’s team is led by Trials Group chair Sean O’Shea and includes partner Michael Petrella.
