Kroger/Albertsons Blocked Over Weak Divestiture Buyer

Cadwalader counsel Bilal Sayyed spoke with GCR about the Federal Trade Commission's preliminary injunction against Kroger's $24.6 billion purchase of Albertsons in an article, "Kroger/Albertsons Blocked Over Weak Divestiture Buyer," published on December 11.

Bilal said the divestiture did not take the FTC's concerns seriously enough that retail stores could flip from being profitable to floundering.

"It just had a mix-and-match quality and it can be hard to convince both the staff and court that this is going to work," said Bilal.
