Cadwalader Partner's Phara Guberman and Kenneth Breen are featured in a recent Bisnow article discussing how regulatory decisions from the Securities and Exchange Commission and the Financial Industry Regulatory Authority are playing into the decisions of major banks to bring some workers back to the office every day.
“The return to work is nothing new, but the SEC's ramp-up of enforcement action for off-channel communications certainly is,” said Phara Guberman.
Phara, along with Kenneth Breen, said remote work does bring additional risks for companies whose workers deal with material nonpublic information. This kind of information is commonplace for many public companies, including REITs.
