Trump Admin Commits to Biden-era Merger Guidelines

Cadwalader counsel Bilal Sayyed spoke with Global Competition Review about the new leadership at the Federal Trade Commission's decision to largely maintain the 2023 Merger Guidelines in an article, "Trump Admin Commits to Biden-era Merger Guidelines," published February 18.

FTC Chair Andrew Ferguson announced recently that he would not revoke the guidelines issues by the the Biden Administration because "they are largely a restatement of prior iterations and antitrust precedent."

Bilal agreed with the decision, while noting that some changes and tweaks to the guidelines would make sense in the next few years.

“This is a totally sensible approach,” he said, adding that starting a guidelines project takes up a lot of resources and Ferguson may not be willing to commit just yet.
